The Internet Services Service Order is submitted by the applicant and accepted by Jasper County Rural Electric Membership Corporation d/b/a Connect-Internet by Jasper County REMC (“REMC”) together with the REMC Terms and Conditions of Information and Communication Service as may be amended from time to time by REMC and any other policies, rules, or regulations incorporated therein, constitute the Internet Services Agreement between Customer and REMC.

Effective May 10, 2022

The following terms and conditions apply to all information and communications services provided by Jasper County Rural Electric Membership Corporation dba Connect-Internet by Jasper County REMC or its affiliates, contractors, vendors, or agents (hereafter “REMC”, “Company”, “we” or “us”) including, but not limited to, internet service, voice over internet protocol service, any other information or communications service provided by Company, and construction and installation services (collectively, the “Services”). These REMC Terms and Conditions of Information and Communications Services may be amended from time to time in the sole discretion of the Company, provided however that we will provide at least thirty (30) days’ notice to you before implementing any amendments. These REMC Terms and Conditions of Information and Communications Services, as amended from time to time by REMC and any terms and conditions set forth on a Service Order executed by Customer together form the agreement between the Company and Customer (“Agreement”).

1. Services, Rates, Charges, Terms and Conditions Subject to Change. Customer acknowledges and agrees that the services, rates, and charges set forth on any Internet Services Service Order may be amended or revoked by REMC at any time, provided however, that REMC will provide at least thirty (30) days prior notice to Customer before implementing any price change or amending revoking any service offering. Such changes may include pricing, service features, and consumer eligibility requirements. Any promotions offered by REMC may be strictly limited and subject to change with respect to length, market and circumstances offered. Such promotions may not be available to all consumers. We reserve the right to further amend the Agreement to change or add terms and conditions of use. You agree so long as we notify you of these changes in through reasonable means of notification; you will abide by such additional terms and conditions. You acknowledge and understand that if your Agreement with us is month-to-month and, if you do not agree with any changes to the Agreement, you may cancel your service. If your Agreement with us is for a term longer than one month (e.g. 12 or 24 months) and you do not agree with a change to the Agreement materially adverse to you, you may terminate your service with no further liability by delivering written notice to us no later than thirty (30) days following the date we notify you of the change. Your continued use of the services after the expiration of such thirty (30) day period will be deemed your consent to any such changes.

  1. Pursuant to Ind. Code ch. 8-1-29, Jasper County REMC shall not switch the Consumer to a different telecommunications provider or bill the Consumer for services added to the Consumer’s service order without the Consumer’s authorization. Additionally, Jasper County REMC shall not submit a preferred carrier change order unless the order has first been confirmed in accordance with the procedures described in Ind. Code § 8-1-29-5.5. Notwithstanding any other provision of this Agreement to the contrary, Customer may file a complaint with the Indiana Utility Regulatory Commission for violation of these provisions in accordance with Ind. Code § 8-1-29-7.
  2. Notwithstanding any other provision of this Agreement to the contrary, Customer shall have all customer telecommunications service rights now or hereafter set forth in 170 IAC 7-1.3 including, but not limited to, notice of proposed rate changes, billing in compliance with 170 IAC 7-1.3-6, billing adjustments to the known date of error or for a period of eighteen (18) months, whichever is shorter, prohibition on unauthorized switching of telecommunications providers and billing for telecommunications services added without the Consumer’s consent, and Consumer complaints to the IURC.

2. Term, Billing, Payment. Unless otherwise specified on a Service Order, the term of the Agreement is month-to-month. With the exception of usage-based charges, you will be billed monthly in advance for the Services. In addition, installation, set up, or construction charges may apply. You agree to pay all charges stated in your bill, including any taxes or surcharges by the due date shown on the bill, (the “Due Date”). The REMC may add a late payment charge of $10.00 if any portion of the bill is not paid in full by the Due Date. Customer agrees to pay all costs and expenses incurred by REMC in collecting any past amount due from Customer, including, but not limited to, court costs, service fees, collection fees, and attorney’s fees.

3. Disconnection for Non-Payment and Reconnection. REMC may disconnect and discontinue service if Customer fails to pay a bill in full by the Due Date, and the REMC may charge its then-current disconnect and reconnect fees prior to reconnecting service.

4. Early Termination Charges. If your Services are for a term of more than one month and are terminated by you for any reason prior to the expiration of your then current term or by us due to your breach of this Agreement, including your failure to pay, we may charge you, as liquidated damages and not as a penalty, an amount equal to (i) any outstanding and unpaid amounts, whether or not previously invoiced, for Services rendered prior to the date the Services are terminated, (ii) 100% of the monthly recurring fees for the terminated Services, including usage based fees, multiplied by the number of months remaining on the then current term, and (iii) any unpaid non-recurring fees associated with the terminated Services, including any costs and charges incurred by us related to the installation and implementation of the Services. Such Early Termination Charges will be due within thirty (30) days of Service cancellation.

5. Equipment. In order to provide the Services, we will install equipment in and around your premises. This equipment may include, but is not limited to, a Network Interface Device (“NID”), routers, and cabling (collectively the “Equipment”). The Equipment is our property. You agree that you will not move any of the Equipment to another location outside your premises either temporarily or permanently. You are responsible for the care and maintenance of the Equipment located at your premises. You agree not to modify the Equipment in any way. If any of the Equipment is damaged, modified, lost, destroyed, tampered with, or stolen while in your possession, you will be responsible for the reasonable cost of repair or replacement of the affected Equipment. When you cease being a consumer or move from your current location, you are responsible for returning the Equipment to us (with the exclusion of any wiring or Equipment located outside your premises). If you paid a deposit when you initiated service, we will apply any remaining portion of the deposit to the costs we incur to repair or replace damaged or unreturned Equipment. You will be responsible for any costs that exceed the deposit.

6. Installation; Access to Premises. You hereby authorize REMC Parties (defined for purposes of this Section to include REMC officers, employees, contractors, vendors, and agents) to install, construct, locate, replace, repair, upgrade, and remove Equipment over, in, around, under, and through the premises and any property adjacent to the premises necessary to provide the Services. You hereby authorize REMC Parties to enter your premises during normal business hours, or by appointment, to install, inspect, maintain, replace, or remove the Equipment. You also grant REMC Parties the right to enter onto your property at all reasonable times, even if you are not present, to install, inspect, maintain, replace or remove any of the Equipment located outside your premises. Unless REMC Parties are grossly negligent or intentionally harm any persons or property, REMC Parties will not be responsible or liable for any damages caused by us or our employees, contractors, vendors, and agents, while performing work on your property or in your premises. REMC Parties are not responsible for the operation, maintenance and repair of your telephone, computer or any other device owned by you to which REMC Parties establish a connection. You may not install any device or equipment to our inside wiring or Equipment that will impair the integrity of our Equipment or network, including, but not limited to, cable signal and bandwidth leakage. You agree that REMC Parties will have no liability for any lost wages and expenses you may incur as a result of any present or future work to be performed by REMC Parties or any appointment made to perform present or future work.

If you are not the owner of the premises or other premises upon which our Equipment or Services are to be installed, you warrant that you have obtained the consent of the owner of the premises for our representatives to enter the premises for the purposes described in this section and install Equipment over, in, around, under, and through the premises and any property adjacent to the premises necessary to provide the Services. You agree to indemnify and hold harmless the Company, its affiliates and their representatives from and against any claims of the owner of the premises arising out of the performance of this Agreement (including costs and reasonable attorneys’ fees). In some instances, installation, set up or construction charges may apply as specified on a Service Order.

If you are the owner of the premises or other premises upon which our Equipment or Services are to be installed, you acknowledge and agree that: (i) you consent to the expansion of the electric easement that REMC has on the property to include communications infrastructure; (ii) You are not entitled to any additional compensation for the expansion of the electric easement to include communications infrastructure other than the value of the Services provided by REMC; (iii) you shall be subject to penalties for perjury and/or liable for any just compensation provided for by law if you falsely represent to REMC that you are the owner of the premises or the designated agent of the owner and signs this Installation and Service Agreement without the consent of the true owner of the premises or the designated agent of the owner.

7. Suspension of Services. In the event that we reasonably believe that you are using the Services for any detrimental or unlawful purpose or in contravention with the terms and provisions of the Agreement, without limiting any of our legal remedies, we may immediately discontinue one or all of your Services without notice to you or liability. Upon such occurrence any prepaid fees will be forfeited by you. Revocation of service does not relieve you of the obligation to pay any amount due and owing as of the date of termination, including any early termination charges.

8. Excessive Use by Customer. If, in our sole judgment, you are uploading and/or downloading a significant amount of data, we reserve the right to impose a reasonable usage-based charge and/or change your subscription to a higher Internet service package as a condition of continuing service with us. If, in our sole and reasonable judgment, you are excessively using any of our phone service features or packages, including but not limited to unlimited long distance, we reserve the right to require you to subscribe to a higher-level phone service package as a requirement of continuing your phone service with us. You agree any applicable long distance rates will be calculated based upon the telephone numbers of the calling parties and not necessarily the current physical locations of the calling parties.

9. Policies. In addition to these Terms & Conditions, our Acceptable Use Policy, Broadband and VOIP Copyright Infringement Policy, and Privacy Policy govern the use of our Services (“Policies”). These Policies are hereby incorporated by reference and made a part of the Agreement. Furthermore, if you are a Lifeline subscriber, the terms & conditions set forth in the Lifeline policy will apply to your service. The Policies may be amended from time to time in the sole discretion of Jasper County REMC. You agree to read and abide by such Policies as may be amended from time to time. The Policies are available on our web page and, if you call our consumer service department, we will provide a copy of the Policies to you.

10. High Speed Internet Services. To the extent you receive high speed Internet service from us; you agree to abide the following terms and conditions. These terms and conditions supersede all other High Speed Internet Service terms and conditions in the Agreement.

  1. As a part of our Internet service, we may provide you with access to software downloads for things like virus protection, spam filtering and pop up blockers. So long as you are our consumer, you have a limited license to use such software for your personal use only. You are prohibited from reverse engineering, copying, or otherwise modifying any of the software code. In the event you cancel your high speed Internet service with us, you agree to stop using such software and destroy any copies of the software you have made on your computer or otherwise.
  2. The internet access speeds quoted shall be the maximum rates by which downstream internet access data may be transferred between REMC facilities and the network interface device at the Consumer’s home, office, or apartment building. The maximum rate shall not be guaranteed and may vary. The quoted speeds may not be the speed at which the Consumer’s modem shall receive and send internet access data through the public internet, as such speeds may be impacted by many factors beyond Jasper County REMC’s control. Actual internet speeds may vary due to many factors including the capacity or performance of the Consumer’s computer or modem and its configuration, the Consumer’s wiring and any wireless configuration, the Consumer’s destination and internet traffic, the Consumer’s internal network or other factors at the internet site with which the Consumer is communicating, congestion on the network, and the general speed of the public internet. The actual speed may affect the Consumer’s online experience including ability to view streaming video and speed of downloads. Except as otherwise provided by law, Jasper County REMC may implement network management controls to optimize and ensure that adequate speed and data transfer shall be available to all internet service Customers.
  3. You understand and acknowledge that we reserve the right to restrict any content or services that may otherwise be available through your Internet connection if we determine, in our sole judgment, that: (i) such content is illegal; or (ii) our network or business is put at risk by such content.

11. Additional Phone Service Terms and Conditions. If you choose to receive voice over internet protocol phone service through the Company’s internet system, you agree to abide the following terms and conditions. These terms and conditions are in addition to all other phone service terms and conditions in the Agreement.

  1. You may not use the phone service for any of the following: (i) autodialing or continuous or excessive call forwarding; (ii) fax broadcast or fax blasting; (iii) telemarketing including, without limitation, polling, political solicitation, or charitable solicitation; (iv) unlawful activities; (v) abusive conduct including, without limitation, threatening, harassing or fraudulent behavior; or (vi) any purpose that threatens the safety, security or use of our network or our business including, but not limited to, excessive usage. You may not resell our phone service or equipment.
  2. Special Provisions Regarding E911 and Other Emergency Services. YOUR VOICE SERVICES INCLUDE 911/ENHANCED 911 (E911) FUNCTIONALITY THAT MAY DIFFER FROM THE 911/E911 FUNCTIONALITY FURNISHED BY OTHER PROVIDERS. CAREFULLY READ THE INFORMATION BELOW. YOU ACKNOWLEDGE AND ACCEPT ANY LIMITATIONS OF 911/E911 USING THE COMPANY’S VOICE SERVICES. YOU AGREE TO ADVISE ALL PERSONS WHO MAY HAVE OCCASION TO PLACE CALLS OVER OUR VOICE SERVICES OF THESE LIMITATIONS. You acknowledge that your services are electrically powered and that your voice services, including the ability to access 911/E911 emergency services and home security and medical monitoring services may not operate in the event of an electrical power outage or if your Internet Services connection is disrupted or not operating. The location and address associated with your voice services will be the address identified on the service order. You acknowledge that under the terms of this agreement, you are not permitted to move the Company’s Equipment (including phones we provide) from the location in which it has been installed. If you do so, you do so in violation of this Agreement and at your own risk. Furthermore, if you move your phone or other Equipment to an address different than that identified on the service order, calls from you to 911 will appear to 911 emergency service operations to be coming from the address identified on the service order and not the new address. We utilize telephone numbers that are assigned in accordance with industry guidelines and are used, in our view, in compliance with applicable law or our processes and procedures. You understand that 911/E911 may not function if voice services are interrupted for any reason, including but not limited to failure of Company Equipment, a power outage, failure of the Company’s network or facilities, network congestion, or suspension or disconnection of your services because of nonpayment.
  3. Transfer of Telephone Numbers: You may transfer your phone number(s) to or from us if the other service provider agrees to release or accept the transfer; performs the transfer without delay and without imposing non-industry-standard charges; you request the phone number transfer when you place your order for service; and the transfer of your phone number(s) does not, in our view, violate applicable law or our processes and procedures.

12. Service Fees and Restoration of Service

  1. Service Calls, Coverage. When you call us to report trouble with a Service, we will test to determine the origin of the problem. If we determine that the problem is coming from cables or connections we installed outside of your home or business, subject to the limitations in this Agreement, we will repair or replace the defective wiring and/or jacks at no cost to you. If we determine that the problem is coming from any other source within your premises including, but not limited to, your equipment or wiring you installed, we reserve the right to charge you a trip charge and the costs we incur (time & materials) for any work we perform on your behalf to fix the problem.
  2. Exceptions to Coverage. REMC will charge Customer a trip charge and the costs we incur (time and materials) for any work we perform on your behalf to fix problems related to: (i) any damage caused by an “Act of God” (earthquake, flood, acts of war, fire, lightning, wind or fire), rodents or insects, or other environmental circumstances beyond our control; (ii) gross or intentional damage caused by you to the inside wiring; (iii) damage to our Equipment caused by you (iv) any wiring you install; (v) repair or replacement of any of your equipment; (vi) repair or replacement of wires or jacksthat we cannot access; (vii) any wiring issuesthat existed prior to the date we installed the Services at your premises; and (viii) problems occurring in any horizontal or vertical risers owned by another party.
  3. Protection Plan. If you have elected to add the Protection Plan to your service, the terms and conditions of the Protection Plan shall supersede the terms of this Agreement to the extent the Protection Plan conflicts with this Agreement.

13. Limitation of Liability and Warranty. CONSUMER AGREES THAT ALL SERVICES ARE PROVIDED BY COMPANY ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE, NON INFRINGEMENT OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR THAT SUCH SERVICES WILL BE ERROR FREE. COMPANY MAKES NO WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, OR WILL SECURE CONSUMER’S COMPUTER FROM THIRD PARTY UNAUTHORIZED ACCESS OR MONITORING. CONSUMER AGREES THAT ALL USE OF THE SERVICES IS AT CONSUMER’S SOLE RISK AND CONSUMER EXPRESSLY ACKNOWLEDGES AND ACCEPTS THE SERVICES KNOWING THAT SUCH SERVICES ARE SUBJECT TO INTERRUPTION FROM POWER OUTAGES AND EQUIPMENT FAILURES. IN NO EVENT WILL COMPANY, ITS AFFILIATES OR PARENT CORPORATION, BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH THE INSTALLATION, REPAIR, REPLACEMENT, OR REMOVAL OF COMPANY’S EQUIPMENT, THE USE OR INABILITY TO USE THE SERVICES, OR THE USE OR INABILITY TO USE ANY THIRD PARTY SERVICES INCLUDING, BUT NOT LIMITED TO E911 SERVICE AND HOME SECURITY OR MEDICAL MONITORING SERVICE, INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL SPECIAL CONSEQUENTIAL OR PUNITIVE DAMAGES, WHETHER OR NOT THERE IS NEGLIGENCE ON THE PART OF COMPANY AND WHETHER OR NOT COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. IN NO EVENT WILL COMPANY’S LIABILITY EXCEED THE AMOUNT ACTUALLY PAID BY CONSUMER FOR THE SERVICES.

14. Indemnification. Customer agrees to defend, indemnify and hold harmless Company, its affiliates and Parent Corporation, from and against any and all claims and expenses, including reasonable attorneys’ fees, arising out of or related in any way to the use of the Services by Customer or otherwise arising out of Customer’s breach of any term of the Agreement.

15. Jurisdiction and Venue. Jurisdiction and venue for all disputes will be Jasper County, Indiana. Both parties expressly waive the right to request a trial by jury regarding any legal dispute arising from this Agreement.

16. Miscellaneous. The Agreement may not be assigned by Customer. Company may assign this Agreement without Customer consent. The invalidity or unenforceability of any provision of the Agreement shall not affect the other provisions, and the Agreement shall be construed in all respects as if such invalid or unenforceable provision had not been a part of the Agreement. The format, words and phrases used in this Agreement shall have the meaning generally understood in the information, internet, and communications industries. This Agreement shall be construed in accordance with its fair meaning and not against the drafting party. The Agreement, along with the terms and conditions set forth in any Service Order represents the entire understanding between the parties and supersedes all prior agreements and representations whether express or implied, oral or written. Customer acknowledges that Customer is not entering into this Agreement in reliance on any term, condition, representation or warranty not expressly stated in the Agreement. The following provisions shall survive the expiration or termination of the Agreement: Sections 4, 5, 6, 7 and 8.

17. Electronic Signatures, Notices and Disclosures. Customer consents to the use of electronic signatures for all agreements with us and consents to receive any or all notices and disclosures we send online or through other electronic means.

18. Cooperation with Law Enforcement. If, in our sole and reasonable judgment, we believe you are using any of our Services for an illegal purpose, you acknowledge and agree that we may provide information about your usage to proper legal authorities for investigation and prosecution. You also agree that we may forward information about you and your use of Services in response to law enforcement requests, subpoenas, court orders or similar requests when we reasonably determine that the disclosure of such information is appropriate and warranted under the circumstances. 1777268

Jasper County Rural Electric Membership Corporation dba Connect-Internet by Jasper County REMC Broadband and VOIP Acceptable Use Policy

Effective Date of Policy: April 12, 2022

This Acceptable Use Policy (the “Policy”) outlines acceptable use of Jasper County Rural Electric Membership Corporation’s (“Jasper County REMC”) fiber internet service (the “Service”). This Policy is in addition to any restrictions or conditions contained in any customer or subscriber agreement executed by you and Jasper County REMC with respect to the Service (each a “Subscriber Agreement”).

All Jasper County REMC customers receiving the Service (the “customer,” “user,” “you” or “your”) and all others who use the Service must comply with this Policy. Your failure, or others’ failure, to comply with this Policy could result in the suspension or termination of your or their Service accounts. Therefore, you should take steps to ensure that others you permit to use your Service are aware of this Policy and agree to abide by it. If you are unwilling to comply with this Policy, you must immediately stop all use of the Service and notify Jasper County REMC so that it can close your account.

How will I know when Jasper County REMC changes this Policy, and how do I report violations of it? 

Jasper County REMC may revise this Policy from time to time by posting a new version on its website at www.connectjasper.com (the “Website”). Jasper County REMC will use reasonable efforts to make customers aware of any changes to this Policy, which may include sending email announcements or posting information on the Website. Revised versions of this Policy are effective immediately upon posting. Accordingly, customers of the Service should read any Jasper County REMC announcements they receive and regularly visit the Website and review this Policy to ensure that their activities conform to the most recent version. You can send questions regarding, and reports violations of, this Policy to Chief Executive Officer.

I. Prohibited Uses and Activities

What uses and activities does Jasper County REMC prohibit? 

In general, the Policy prohibits uses and activities involving the Service that are illegal, infringe the rights of others or interfere with or diminish the use and enjoyment of the Service by others. For example, these prohibited uses and activities include, but are not limited to, using the Service or customer-provided or Jasper County REMC-provided equipment, either individually or in combination with one another, to:

Conduct and information restrictions 

  • undertake or accomplish any unlawful purpose. This includes, but is not limited to, posting, storing, transmitting or disseminating information, data or material that is libelous, obscene, unlawful, threatening or defamatory or that infringes the intellectual property rights of any person or entity or that in any way constitutes or encourages conduct that would constitute a criminal offense or otherwise violate any local, state, federal or non-U.S. law, order or regulation;
  • post, store, send, transmit or disseminate any information or material that a reasonable person could deem to be unlawful;
  • upload, post, publish, transmit, reproduce, create derivative works of or distribute in any way information, software or other material obtained through the Service or otherwise that is protected by copyright or other proprietary right without obtaining any required permission of the owner;
  • transmit unsolicited bulk or commercial messages commonly known as “spam;”
  • send very large numbers of copies of the same or substantially similar messages, empty messages or messages that contain no substantive content or send very large messages or files that disrupt a server, account, blog, newsgroup, chat or similar service;
  • initiate, perpetuate or in any way participate in any pyramid or other illegal scheme;
  • participate in the collection of very large numbers of email addresses, screen names or other identifiers of others (without their prior consent), a practice sometimes known as spidering or harvesting, or participate in the use of software (including “spyware”) designed to facilitate this activity;
  • collect responses from unsolicited bulk messages;
  • falsify, alter or remove message headers;
  • falsify references to Jasper County REMC or its network, by name or other identifier, in messages;
  • impersonate any person or entity, engage in sender address falsification, forge anyone else’s digital or manual signature or perform any other similar fraudulent activity (for example, “phishing”);
  • violate the rules, regulations, terms of service or policies applicable to any network, server, computer database, service, application, system or website that you access or use;

Technical restrictions

  • access any other person’s computer or computer system, network, software or data without his or her knowledge and consent, breach the security of another user or system, or attempt to circumvent the user authentication or security of any host, network or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, or probing the security of other hosts, networks or accounts without express permission to do so;
  • use or distribute tools or devices designed or used for compromising security or whose use is otherwise unauthorized, such as password guessing programs, decoders, password gatherers, keystroke loggers, analyzers, cracking tools, packet sniffers, encryption circumvention devices or Trojan Horse programs. Unauthorized port scanning is strictly prohibited;
  • copy, distribute or sublicense any proprietary software provided in connection with the Service by Jasper County REMC or any third party, except that you may make one copy of each software program for back-up purposes only;
  • distribute programs that make unauthorized changes to software (cracks);
  • use or run dedicated, standalone equipment or servers from the customer’s premises that provide network content or any other services to anyone outside of your premises local area network (“Premises LAN”), also commonly referred to as public services or servers. Examples of prohibited equipment and servers include, but are not limited to, email, web hosting, file sharing and proxy services and servers;
  • use or run programs from your premises that provide network content or any other services to anyone outside of your Premises LAN, except for personal and non-commercial residential use;
  • service, alter, modify or tamper with the Jasper County REMC-provided equipment or Service or permit any other unauthorized person to do the same;

Network and usage restrictions

  • use the Service for any purpose other than personal and non-commercial residential use (except for your individual use for telecommuting);
  • use the Service for operation as an internet service provider or for any business, other legal entity or organization purpose (whether or not for profit);
  • restrict, inhibit or otherwise interfere, regardless of intent, purpose or knowledge, with the ability of any other person to use or enjoy the Service (except for tools for safety and security functions such as parental controls, for example), including, without limitation, posting or transmitting any information or software that contains a worm, virus or other harmful feature;
  • impede others’ ability to use, send or retrieve information;
  • restrict, inhibit, interfere with or otherwise disrupt or cause a performance degradation, regardless of intent, purpose or knowledge, to the Service or any Jasper County REMC (or supplier thereof) host, server, backbone network, node or service or otherwise cause a performance degradation to any Jasper County REMC (or supplier thereof) facilities used to deliver the Service;
  • resell the Service or otherwise make available to anyone outside of your premises the ability to use the Service (for example, through WiFi or other methods of networking), in whole or in part, directly or indirectly;
  • connect the Jasper County REMC-provided equipment to any computer outside of your premises;
  • interfere with computer networking or telecommunications service to any user, host or network, including, without limitation, denial of service attacks, flooding of a network, overloading a service, improper seizing and abusing operator privileges, and attempts to “crash” a host; or
  • access and use the Service with anything other than a dynamic Internet Protocol (“IP”) address that adheres to the dynamic host configuration protocol (“DHCP”). You may not configure the Service or any related equipment to access or use a static IP address or use any protocol other than DHCP unless you are subject to a Service plan that expressly permits you to do so.

II. Customer Conduct and Features of the Service

What obligations do I have under this Policy?

You are responsible for your own compliance with this Policy. You are also responsible for any use or misuse of the Service that violates this Policy by anyone else you permit to access the Service (such as a friend, family member or guest). Jasper County REMC recommends against enabling file or printer sharing unless you do so in strict compliance with all security recommendations and features provided by Jasper County REMC and the manufacturer of the applicable file or printer sharing devices. Any files or devices you choose to make available for shared access on a home LAN, for example, should be protected with a strong password or as otherwise appropriate.

In all cases, you are solely responsible for the security of any device you connect to the Service, including any data stored or shared on that device. It is also your responsibility to secure the customer-provided equipment and any other premises equipment or programs not provided by Jasper County REMC that connect to the Service from external threats such as viruses, spam, bot nets and other methods of intrusion.

How does Jasper County REMC address inappropriate content and transmissions?

Jasper County REMC reserves the right to refuse to transmit or post, and to remove or block, any information or materials, in whole or in part, that it, in its sole discretion, deems to be in violation of this Policy or otherwise harmful to Jasper County REMC’s network or customers using the Service, regardless of whether this material or its dissemination is unlawful. Neither Jasper County REMC nor any of its affiliates, suppliers or agents have any obligation to monitor transmissions or postings (including, but not limited to, email, file transfer, blog, newsgroup and instant message transmissions) made on the Service. However, Jasper County REMC and its affiliates, suppliers and agents have the right to monitor these transmissions and postings from time to time for violations of this Policy and to disclose, block or remove them in accordance with this Policy, a Subscriber Agreement and applicable law.

What requirements apply to email?

The Service may not be used to communicate or distribute email or other forms of communications in violation of this Policy. As described below, Jasper County REMC uses reasonable network management tools and techniques to protect customers from receiving and sending spam (often without their knowledge over an infected computer).

Jasper County REMC is not responsible for deleting or forwarding any email sent to the wrong email address by you or by someone else trying to send email to you. Jasper County REMC is also not responsible for forwarding email sent to any account that has been suspended or terminated. This email will be returned to the sender, ignored, deleted or stored temporarily at Jasper County REMC’s sole discretion. If you cancel or terminate your Service account for any reason, all email associated with that account (and any secondary accounts) will be permanently deleted as well.

If Jasper County REMC believes, in its sole discretion, that any subscriber name, account name or email address (each an “Identifier”) on the Service may be used for, or is being used for, any misleading, fraudulent or other improper or illegal purpose, Jasper County REMC: (i) reserves the right to block access to and prevent the use of any such Identifier, and (ii) may at any time require any customer to change his or her Identifier. In addition, Jasper County REMC may at any time reserve any Identifiers on the Service for its own purposes.

What requirements apply to instant, video and audio messages?

Each user is responsible for the contents of his or her instant, video and audio messages and the consequences of any of these messages. Jasper County REMC assumes no responsibility for the timeliness, mis-delivery, deletion or failure to store these messages. If you cancel or terminate your Service account for any reason, all instant, video and audio messages associated with that account (and any secondary accounts) will be permanently deleted as well.

III. Network Management 

Why does Jasper County REMC manage its network?

Jasper County REMC manages its network to deliver the best possible broadband internet experience to all of its customers. High-speed bandwidth and network resources are not unlimited. Managing the network is essential as Jasper County REMC works to promote the use and enjoyment of the internet by all of its customers. Jasper County REMC uses reasonable network management practices that are consistent with industry standards and tries to use tools and technologies that are minimally intrusive and, in its independent judgment guided by industry experience, among the best in class. Jasper County REMC expects that its network management practices will evolve along with the uses of the internet and the challenges and threats on the internet. By engaging in responsible network management, including enforcement of this Policy, Jasper County REMC can deliver the best possible broadband internet experience to all of its customers.

How does Jasper County REMC manage its network?

Jasper County REMC uses various tools and techniques to manage its network, deliver the Service and ensure compliance with this Policy and Subscriber Agreements. These tools and techniques are dynamic, like the network and its usage, and can and do change frequently. For example, these network management activities may include: (i) identifying spam and preventing its delivery to customer email accounts, (ii) detecting malicious internet traffic and preventing the distribution of viruses or other harmful code or content, (iii) temporarily lowering the priority of traffic for users who are the top contributors to current network congestion, and (iv) using other tools and techniques that Jasper County REMC may be required to implement in order to meet its goal of delivering the best possible broadband internet experience to all of its customers.

IV. Copyright

How does Jasper County REMC communicate with customers about copyright?

Jasper County REMC is committed to complying with U.S. copyright and related laws and requires all customers and users of the Service to comply with these laws. Jasper County REMC maintains a Broadband and VOIP Copyright Infringement Policy, which is incorporated herein and is available at www.connectjasper.com or upon request. The Broadband and VOIP Copyright Infringement Policy is applicable to and an essential term and condition of service.

V. Violation of Policy

What happens if you violate this Policy?

Jasper County REMC reserves the right to immediately suspend or terminate your Service account and terminate the Subscriber Agreement if you violate the terms of this Policy or the Subscriber Agreement or if anyone else you permit to access the Service violates this Policy.

How does Jasper County REMC enforce this Policy?

Jasper County REMC does not routinely monitor the activity of individual Service accounts for violations of this Policy, except for determining aggregate data consumption. However, Jasper County REMC will respond appropriately if it becomes aware of inappropriate use of the Service. Jasper County REMC has no obligation to monitor the Service and/or the network. Jasper County REMC and its suppliers reserve the right at any time to monitor bandwidth, usage, transmissions and content in order to, among other things, operate the Service, identify violations of this Policy and/or protect the network, the Service and Jasper County REMC users.

Jasper County REMC prefers to inform customers of inappropriate activities and give them a reasonable period of time in which to take corrective action. Jasper County REMC also prefers to have customers directly resolve any disputes or disagreements they may have with others, whether customers or not, without Jasper County REMC’s intervention. However, if the Service is used in a way that Jasper County REMC or its suppliers, in their sole discretion, believe violates this Policy, Jasper County REMC or its suppliers may take any responsive actions they deem appropriate under the circumstances with or without notice. These actions include, but are not limited to, temporary or permanent removal of content, filtering of internet transmissions and the immediate suspension or termination of all or any portion of the Service. Neither Jasper County REMC nor its affiliates, suppliers or agents will have any liability for any of these responsive actions. These actions are not Jasper County REMC’s exclusive remedies, and Jasper County REMC may take any other legal or technical actions it deems appropriate with or without notice.

Jasper County REMC reserves the right to investigate suspected violations of this Policy, including the gathering of information from the user or users involved and the complaining party, if any, and examination of material and data on Jasper County REMC’s servers and network. During an investigation, Jasper County REMC may suspend the account or accounts involved and/or remove or block material that potentially violates this Policy. You expressly authorize and consent to Jasper County REMC and its suppliers cooperating with: (i) law enforcement authorities in the investigation of suspected legal violations, and (ii) system administrators at other internet service providers or other network or computing facilities in order to enforce this Policy. REMC Broadband and VOIP Service Privacy Policy

Effective Date of Policy: December 6, 2022

The purpose of this policy statement is to explain how we treat your Personally Identifiable Information (PII) collected by us relating to your subscription to a broadband service. PII is any information that identifies you individually. Aggregate non individual information about a group of subscribers, which may include you, is not considered PII.

1. Information Collected About You. In the course of providing you our services, we may collect certain information that identifies you personally from all other subscribers. This information may include any of the following: your name, service address, billing address, telephone numbers, social security number, driver’s license number, e-mail address, and credit information. We also maintain consumer service records about you relating to the following: billing and payment records, equipment usage, credit history, violations of your agreement with us, your service packages, the types and location of equipment installed by us in your home, equipment service calls and repairs, and whether you rent or own your home, if required to provision service. We may also collect information about your equipment to aid in providing consumer service support. From time-to-time, we may also collect consumer satisfaction surveys, interviews, and questionnaires from you. We may also keep records of all calls, e-mails, and correspondence received from you and sent to you by us.

2. Why We Collect Your Personal Information. We collect the PII described above to help provide you with the best and highest quality service possible. We also collect this information for related business purposes and as may be required by our contractual and legal obligations.

3. How We Use Your Personal Information. We utilize your PII for the following purposes: installation of equipment, repair and maintenance activities, billing of services, quality of service improvement, consumer service, advertising and marketing, verifying compliance with all applicable laws, verifying compliance with contractual obligations, tax and accounting purposes, and creating and marketing better service packages to you.

4. Parties Who May Receive Your Personal Information. The following parties may receive or have access to PII about you: our employees, agents and contractors, accountants, billing and collection services, credit reporting agencies, and authorized governmental bodies. Unless you object by contacting us, we may also disclose PII to some of our vendors. These vendors are obligated to treat your personal information as confidential and may not disclose it to any third parties without your consent. It is also important for you to understand that we do not sell or give access to your personal information to any third party for telemarketing, direct mail or solicitation.

5. Disclosure Required by Law. As part of civil litigation or a regulatory proceeding, if we are required by a valid court or agency order, we may provide personal information about you to a party requesting such information provided that you are notified of such order by the party to whom the order is directed. We may also disclose your personal information to a governmental entity pursuant to a valid court order, if such entity offers clear and convincing evidence that you are reasonably suspected of engaging in criminal activity and that the information sought would be material to their case, and you are afforded an opportunity to appear and contest such entity’s claim. We may also have to disclose the name and addresses of individuals as they appear in our subscriber records with respect to those who owe, or are owed, welfare support as part of an administrative subpoena from a state welfare agency. No court order or notice to you is required for such disclosure.

6. Retention of Your Personal Information. We may retain your personal information as long as you are our consumer or until it is no longer needed for business or legal purposes, most notably for tax and accounting purposes. When your information is no longer needed for such purposes, we may destroy the information unless there is an outstanding request pursuant to a court order.

7. Access to Your Personal Information. You have the right to inspect any of our records that contain your personal information for the purpose of correcting such records. If you wish to inspect your records, please notify us in writing and we will arrange such access, during normal business hours, at our office. 1781915

Effective Date of Policy: April 12, 2022

The Digital Millennium Copyright Act (“DMCA”) provides a process for a copyright owner to give notification to a service provider, such as Jasper County Rural Electric Membership Corporation (“Jasper County REMC”), of claimed copyright infringement. In compliance with the DMCA, Jasper County REMC will respond to proper notifications of claimed infringement and terminate, in appropriate circumstances, the accounts of subscribers who are repeat infringers.

Jasper County REMC is committed to complying with U.S. copyright and related laws and requires all customers and users of the Service to comply with these laws. Accordingly, you may not store any material or content on, or access, share or disseminate any material or content over, the Service (or any part of the Service) in any manner that constitutes an infringement of third-party intellectual property rights, including rights granted by U.S. copyright law. Jasper County REMC complies with the DMCA and provides a method for copyright owners to communicate information about alleged infringements to us and for us to inform our customers about them. You may receive notices or alerts if your Service account is identified by a copyright owner as having been used in connection with acts of alleged copyright infringement.

What is Jasper County REMC’s DMCA policy?

Owners of copyrighted works who believe that their rights under U.S. copyright law have been infringed may take advantage of certain provisions of the DMCA to report alleged infringements. It is Jasper County REMC’s policy in accordance with the DMCA and other applicable laws to reserve the right to terminate the Service provided to any customer or user who is either found to infringe third-party copyright or other intellectual property rights, including repeat infringers, or who Jasper County REMC, in its sole discretion, believes is infringing these rights. Jasper County REMC may terminate the Service at any time with or without notice for any affected customer or user.

How do copyright owners report alleged infringements to Jasper County REMC under the DMCA?

Copyright owners may report alleged infringements of their works by sending Jasper County REMC’s authorized agent a notification of claimed infringement that satisfies the requirements of the DMCA. Upon Jasper County REMC’s receipt of a satisfactory notice of claimed infringement for these works, Jasper County REMC will respond expeditiously to either directly or indirectly: (i) remove the allegedly infringing work(s), if applicable, or (ii) disable access to the work(s). Jasper County REMC will also promptly notify the affected customer or user of the Service of the removal or disabling of access to the work(s).

Copyright owners may send Jasper County REMC a notification of claimed infringement to report alleged infringements of their works under the DMCA to:

Copyright owners may use their own notification of claimed infringement form that satisfies the requirements of Section 512(c)(3) of the U.S. Copyright Act. Under the DMCA, anyone who knowingly makes misrepresentations regarding alleged copyright infringement may be liable to Jasper County REMC, the alleged infringer and the affected copyright owner for any damages incurred in connection with the removal, blocking or replacement of allegedly infringing material.

What can customers do if they receive a DMCA notification of alleged infringement?

If you receive a DMCA notification of alleged infringement as described above and you believe in good faith that the allegedly infringing works have been removed or blocked by mistake or misidentification, then you may send a counter notification to Jasper County REMC. Upon Jasper County REMC’s receipt of a counter notification that satisfies the requirements of the DMCA, Jasper County REMC will provide a copy of the counter notification to the person who sent the original notification of claimed infringement and will follow the DMCA’s procedures with respect to a received counter notification, including, without limitation, reinstating the removed material and/or reestablishing access to the same within 10-14 business days after receipt of the counter notification, unless the person who sent the original notification seeks a court order against the customer. In all events, you expressly agree that Jasper County REMC will not be a party to any disputes or lawsuits regarding alleged copyright infringement.

If a notification of claimed infringement has been filed against you, you can file a counter notification with Jasper County REMC’s designated agent using the contact information above. All counter notifications must satisfy the requirements of Section 512(g)(3) of the U.S. Copyright Act.

I. Notice of Claimed Copyright Infringement: 

Pursuant to the DMCA, copyright owners may submit to the designated agent of a service provider a notice of claimed copyright infringement carried out on the service provider’s network or on the service provider’s system.

When Jasper County REMC receives a proper notification of claimed copyright infringement from a copyright owner or its authorized agent under the DMCA, it will take the following steps:

  1. First warning – Jasper County REMC will send a letter to the subscriber describing the claimed copyright infringement and stating that the infringement constitutes a violation of Jasper County REMC’s Acceptable Use Policy (“AUP”) and terms and conditions of service. The letter will also inform the subscriber that Jasper County REMC may suspend or terminate service if violation continues.
  2. Second warning – If there is a second offense within a 12-month period, Jasper County REMC will send a second warning letter. This letter will notify the subscriber of the claimed copyright infringement and violation of the AUP and terms and conditions of service. The letter will also inform the subscriber that Jasper County REMC may suspend or terminate service if violation continues.
  3. Final warning – If there is a third offense in a 12-month period, Jasper County REMC will issue a final warning letter to the subscriber. This letter will be sent via certified mail. This letter will notify the subscriber of the claimed copyright infringement and violation of the AUP and terms and conditions of service. The letter will also inform the subscriber that Jasper County REMC may suspend or terminate service if violation continues.
  4. Notice of termination – If there is a fourth offense in a 12-month period, Jasper County REMC will terminate the subscriber’s service and send a letter to the subscriber via certified mail. This letter will notify the subscriber that its account has been terminated effective immediately and that all equipment should be returned to Jasper County REMC.

Jasper County REMC reserves the right to act immediately and without notice to suspend or terminate services in response to a court order or other legal requirement that certain conduct be stopped or when Jasper County REMC determines that the allegedly infringing conduct may:

  • Expose Jasper County REMC to sanctions, prosecution or civil action;
  • Cause harm to or interfere with the integrity or normal operations of Jasper County REMC’s network or facilities;
  • Interfere with another person’s use of Jasper County REMC services or the internet;
  • Damage or disparage the reputation of Jasper County REMC or its services; or
  • Otherwise present a risk of harm to Jasper County REMC or its subscribers, employees, officers, directors, agents or other representatives.

If Jasper County REMC’s designated agent receives an effective counter notification from a subscriber under the DMCA, Jasper County REMC will replace any removed material and/or restore access to the subscriber’s service, if the subscriber’s account has been terminated, between 10 and 14 business days following receipt of the counter notification, unless as otherwise provided by law.

II. Record Retention: 

All copyright infringement notifications received, related supporting documentation and related correspondence with the subscriber shall be retained by Jasper County REMC for at least five years.

A database that includes account numbers, dates of notification and other pertinent information related to copyright infringement notices and correspondence will also be maintained by Jasper County REMC.

III. Designated Agent: 

The Chief Executive Officer shall be Jasper County REMC’s designated agent to receive all copyright infringement and DMCA notifications. This position, with the help of IT and customer support, is responsible for carrying out the steps of this policy.
